U.S. Citizenship and Immigration Services (USCIS) announced today, June 11th, that premium processing (guarantees that the applicant will receive a decision from USCIS within 15 days of receipt of the application) will be available for Form I-140 applications for workers who meet the following requirements: (1) are currently in H-1B nonimmigrant status; (2) will reach the 6th year of their H-1B stay in 60 days; (3) are only eligible for a further H-1B extension upon approval of their I-140 petition; and (4) cannot otherwise extend their H-1B status.
